Resolution No. 100-2012 applies to all vehicle and container parking in Springfield Township, including, but not limited to, parking on any township street or highway, parking on established roadways proximate to buildings, and parking on private property as necessary to provide access to the property by public safety vehicles and equipment. Resolution No. 100-2012 also provides a permitting process for the location of moving vans, semi-trailers, trailers, dumpsters, and portable storage units (PODS) and outlines the administration, enforcement, and penalties for violations of the Resolution.The Resolution consists of the following Chapters and Sections:

Pursuant to Resolution No. 100-2012, persons who violate any of the parking regulations or order adopted pursuant to those regulations is guilty of a minor misdemeanor and may have their vehicles towed and impounded.

AMENDING RESOLUTION NUMBER 72-2011 AND THE SPRINGFIELD TOWNSHIP PARKING REGULATIONS
WHEREAS, the Board of Trustees of Springfield Township, Hamilton County, Ohio, met in Regular Session on the 9th day of October, 2012 at the Springfield Township Administration Building, 9150 Winton Road with the following members present: Tom Bryan Joseph Honerlaw Gwen McFarlin
Trustee Tom Bryan moved for the adoption of the following Resolution:
WHEREAS, on October 12, 2010, the Board of Township Trustees adopted Resolution Number 86-2010 entitled, "Repealing All Previously-Enacted Parking Resolutions of the Township and Adopting 'The Springfield Township Parking Regulations,' a Comprehensive Parking Code to be Applied Throughout Springfield Township;"
WHEREAS, on March 8, 2011, the Board of Township Trustees adopted Resolution Number 23-2011 entitled, “Amending Resolution Number 86-2010 Entitled “Repealing All Previously-Enacted Parking Resolutions Of The Township And Adopting “The Springfield Township Parking Regulations,” A Comprehensive Parking Code To Be Applied Throughout Springfield Township;”
WHEREAS, on August 9, 2011, the Board of Township Trustees adopted Resolution 72-2011 entitled, “Amending Resolution Number 23-2011 and the Springfield Township Parking Regulations;
WHEREAS, since the enactment of Resolution Number 72-2011, the Board of Township Trustees has determined Sections 301.1, 301.3, and 303.3 should be modified to better define the terms and to eliminate parking prohibitions that are no longer necessary.
NOW THEREFORE BE IT RESOLVED BY THE SPRINGFIELD TOWNSHIP BOARD OF TRUSTEES that the Springfield Township Parking Regulations as enacted by Resolution Number 23-2011 and amended by Resolution Number 72-2011 should be AMENDED to read as follows:
CHAPTER 1
SCOPE AND ADMINISTRATION
SECTION 101
GENERAL
101.1 Title. These regulations shall be known as the Springfield Township Parking Regulations, hereinafter referred to as "these regulations."
101.2 Repeal of Prior Parking Resolutions. As is stated with more specificity in Resolution No. 86-2010, these regulations are enacted pursuant to Ohio Revised Code Section 505.17 and repeal and replace all of the previously-enacted resolutions of Springfield Township pertaining to parking.
101.3 Scope. The provisions of these regulations shall apply to all vehicle parking in Springfield Township, including, but not limited to, parking on any township street, or highway, parking on established roadways proximate to buildings, and parking on private property as necessary to provide access to the property by public safety vehicles and equipment.
101.4 Intent. These regulations shall be construed to secure its expressed intent, which is to ensure public health, safety and welfare insofar as they are affected by parked vehicles impeding travel.
101.5 Severability. If a section, subsection, sentence, clause or phrase of these regulations is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of these regulations.
SECTION 102
APPLICABILITY
102.1 General. The provisions of these regulations shall apply to all matters affecting or relating to parking in the Springfield Township.
102.2 Existing remedies. The provisions of these regulations shall not be construed to abolish or impair existing remedies of Springfield Township or its officers or agencies relating to the citation or removal of illegally or dangerously parked vehicles.
CHAPTER 2
DEFINITIONS
SECTION 201
GENERAL
201.1 Scope. Unless otherwise expressly stated, the following terms shall, for the purposes of these regulations, have the meanings shown in this chapter.
201.2 Interchangeability. Words stated in the presence tense include the future; words stated in the masculine gender include the feminine and neuter; the single number includes the plural and the plural, the singular.
201.3 Terms not defined. Where terms are not defined in these regulations the usual customary definition shall apply.
201.4 Capitalization. Defined words may be begin with an uppercase or lower case letter, interchangeably and without significance as to their meaning.
SECTION 202
GENERAL DEFINITIONS
BICYCLE. A bicycle is a device, other than a tricycle designed solely for use as a play vehicle by a child, propelled solely by human power upon which any person may ride having two tandem wheels, or one wheel in the front and two wheels in the rear, or two wheels in the front and one wheel in the rear, any of which is more than fourteen inches in diameter.
DRIVER OR OPERATOR. A driver or operator is any person who drives or is in actual physical control of a vehicle, trackless trolley, or streetcar.
DUMPSTER. Any container designed or used for the collection and hauling of waste or debris, including but not limited to roll-off containers or boxes and bin containers.
MOTORIZED BICYCLE. A motorized bicycle is any vehicle having either two tandem wheels or one wheel in the front and two wheels in the rear, that is capable of being pedaled and is equipped with a helper motor of not more than fifty cubic centimeters piston displacement that produces no more than one brake horsepower and is capable of propelling the vehicle at a speed of no greater than twenty miles per hour on a level surface.
MOVING VAN. A truck with an enclosed cargo space generally used for the moving of residential or commercial property from one location to another.
OWNER. Any person having a legal or equitable interest in property or otherwise having control of the property.
PERSON. An individual, corporation, partnership or any group acting as a unit.
PORTABLE STORAGE UNIT (POD). Any container transported to a designated location for storage or moving purposes (typically known as PODS, MODS, etc.).
PREMISES. A lot, plot or parcel of land, easement or public way, including any structures thereon.
PROPERTY. Property has the same meaning as “premises” as that term is defined herein.
PUBLIC WAY. Any street, alley or similar parcel of land essentially unobstructed from the ground to the sky, which is deeded, dedicated or otherwise permanently appropriated the public for public use.
SEMITRAILER. Semitrailer means every vehicle designed or used for carrying persons or property with another and separate motor vehicle so that in operation a part of its own weight or that of its load, or both, rests upon and is carried by another vehicle.
SNOW EMERGENCY. A snow emergency is a condition existing in all or parts of the township whereby snow has accumulated to a depth of three of more inches upon township streets and creates a condition requiring snow removal or treatment by township trucks, plows, or other vehicles.
STREET OR HIGHWAY. A street or highway is the entire width between the boundary lines of every way open to the use of the public as a thoroughfare for purposes of vehicular travel.
TRAILER. A trailer means every vehicle designed or used for carrying persons or property wholly on its own structure and for being drawn by a motor vehicle, including any such vehicle when formed by or operated as a combination of a “semitrailer” and a vehicle of the dolly type, such as that commonly known as a “trailer dolly,” a vehicle used to transport agricultural produce or agricultural production materials between a local place of storage or supply and the farm when drawn or towed on a street or highway at a speed greater than twenty-five miles per hour, and a vehicle designed and used exclusively to transport a boat between a place of storage and a marina, or in and around a marina, when drawn or towed on a street or highway for a distance of more than ten miles or at a speed of more than twenty-five miles per hour.
TRUCK. A truck is every motor vehicle, except trailers and semitrailers, designed and used to carry property.
VEHICLE. A vehicle is every device, including a motorized bicycle, in, upon, or by which any person or property may be transported or drawn upon a highway, except that “vehicle” does not include any motorized wheelchair, any electric personal assistive mobility device, any device that is moved by power collected from overhead electric trolley wires or that is used exclusively upon stationary rails or tracks, or any device, other than a bicycle, that is moved by human power.
TOWNSHIP. Township refers to Springfield Township.
CHAPTER 3
STREET PARKING RESTRICTIONS
SECTION 301
GENERAL PROHIBITIONS
301.1 Intersection Prohibitions. Parking is prohibited on both sides of any street at any point between zero (0) and thirty (30) feet from THE END OF THE RADIUS OF an intersecting street.
301.2 Fire Station Prohibitions. Parking is prohibited on both sides of any street at any point between zero (0) and one hundred (100) feet from the driveway entrance/exit of a fire station.
301.3 Fire Hydrant Prohibitions. Parking is prohibited WITHIN TEN (10) FEET OF A FIRE HYDRANT on the fire hydrant side of any street which is twenty-five (25) or fewer feet wide, for the entire length of the street.
301.4 Unpaved Rights-of-Way. Parking is prohibited on any unpaved portion of any right-of-way.
301.5 Truck/Trailer/Semitrailer Parking Prohibitions. Except as authorized by permit in Section 304 of this Resolution, and with the exception of vehicles which have been registered and licensed as a passenger vehicle or a non-commercial truck and/or unless otherwise posted, no moving van, truck, trailer, or semitrailer shall be permitted to park along any Township street other than to load or unload. Moving vans, trailers and/or semitrailers so parked for loading or unloading must be connected to a towing vehicle at all times.
301.6. Portable Storage Unit (POD) and Dumpster Parking Prohibitions. Except as authorized by permit in Section 304 of this Resolution, no portable storage unit (POD) or dumpster shall be permitted to park along any Township street other than to load or unload. Portable storage units (PODS) and dumpsters so parked for loading or unloading must be connected to a towing vehicle at all times.
301.7. Seventy-Two (72) Hour Parking Limitation. Parking is prohibited for longer than seventy-two (72) hours on any street or other property open to the public for purposes of vehicular travel, or upon or within the right-of-way of any street unless the owner of the vehicle notifies the chief of police of the need to leave the vehicle parked in such areas for longer than seventy-two (72) hours and receives permission to so park the vehicle.
SECTION 302
PROHIBITIONS ON DESIGNATED STREETS
302.1 General Statement. The parking prohibitions set forth in this section have been established due to specific traffic hazards and safety concerns.
302.2 Schedule Established. As the designation of particular streets on which parking is prohibited is subject to change based on various conditions affecting each street, the Township shall establish a schedule contemporaneously with the adoption of this Resolution which lists each street on which parking is prohibited or restricted.
302.3 Modification of Schedule. The Township may modify the schedule of streets on which parking is prohibited or restricted from time to time by resolution to ensure that all streets on which parking is prohibited or restricted are included on the schedule. The schedule may be modified by resolution at any time to allow parking on streets previously designated as no parking or restricted parking and to prohibit or restrict parking on streets on which parking was previously permitted.
SECTION 303
PROHIBITIONS ON DESIGNATED STREETS AT SPECIFIED TIMES
303.1 General Statement. The parking prohibitions set forth in this section have been established due to specific traffic hazards and safety concerns which occur on certain dates and times.
303.2 Finneytown High School. Parking is prohibited at the following locations between the hours of 7:00 a.m. and 9:00 a.m. on school days:
- Fontainebleau Terrace - from Winton Road to Peachblossom Court.
- Mockingbird Lane – from Cottonwood Drive to Fontainebleau Terrace.
- Farmedge Lane – the entire length of the street.
- Mockingbird Lane – from Hempstead Drive to Cottonwood Drive.
303.3 Mt. Healthy High School. Parking is prohibited at the following locations between the hours of 7:00 a.m. and 9:00 a.m. on school days:
Tag Drive – the entire length of the street.Fondulac Court – the entire length of the street.Ranchill Drive - from Pacora Drive to Adams Road.
303.3 4 St. Xavier High School. Parking is prohibited at the following location between the hours of 7:00 a.m. and 9:00 a.m. on school days:
- Wellesley Avenue - between 527 to 491 Wellesley Avenue.
303.4.5 Welch Elementary School. Parking is prohibited at the following location one half hour before and after school hours:
- Elkwood - on the non-fire hydrant side between the driveways at 12057 and 12049 Elkwood.
SECTION 304
PERMITS REQUIRED FOR TEMPORARY PARKING OF MOVING VANS, TRAILERS, SEMI-TRAILERS, DUMPSTERS, AND PORTABLE STORAGE UNITS (PODS),
304.1 General Statement. The parking prohibitions/permitting structure set forth in this section have been established due to specific traffic hazards and safety concerns which occur when large vehicles are parked on Township streets, especially for extended periods of time.
304.2 General Prohibition. As is established in Section 301 of this Resolution, the parking of moving vans, trailers, semi-trailers, dumpsters, and portable storage units (PODS) is generally prohibited on any Township street except to load or unload. In addition, such vehicles and containers so parked for loading or unloading must be connected to a towing vehicle at all times.
304.3 Permit For Temporary Parking Beyond Short Unloading/Loading Period. A temporary parking permit may be issued to allow for the parking of moving vans, trailers, semi-trailers, dumpsters and portable storage units (PODS) beyond the short loading/unloading period permitted by Section 301 of this Resolution.
304.4 Duration of Temporary Parking Permits. Temporary Parking Permits issued pursuant to this Section shall be for the shortest duration possible to fulfill the purposes for which the Temporary Parking Permit was requested. Unless extraordinary circumstances are established by the person requesting the Permit, no Temporary Parking Permit shall be issued for longer than seven (7) days and no more than four (4) Temporary Parking Permits shall be issued to the same person or address in any calendar year.
304.5 Application Process. In order to obtain a Temporary Parking Permit, persons must provide the Township with a completed application which includes the following information:
a) Name, address, and telephone number of the applicant;
b) Address and proposed location of the moving van, trailer, semi-trailer, dumpster or portable storage unit (POD);
c) Type of vehicle or container for which the application is filed;
d) Size of the moving van, trailer, semi-trailer, dumpster, or portable storage unit (POD) for which the application is filed;
e) Name, contact person (including his/her direct telephone/mobile telephone number), address, and general telephone number of the company providing the moving van, trailer, semi-trailer, dumpster, or portable storage unit (POD);
f) Beginning and ending date for which a Temporary Parking Permit is being requested; and
g) Statement of extraordinary circumstances warranting the granting of a Temporary Parking Permit for longer than seven (7) days or more than four(4) such permits in one (1) calendar year.
304.6 Criteria for Granting a Temporary Parking Permit. Temporary parking permits for moving vans, trailers, semi-trailers, dumpsters, and portable storage units (PODS) will be issued to persons:
a) Who cannot reasonably locate the moving van, trailer, semi-trailer, portable storage unit (POD), or dumpster on an impervious surface other than on the Township street or in the Township right-of-way; and
b) Who are utilizing the moving van, trailer, semi-trailer, dumpster, or portable storage unit (POD) for bona fide moving, rehabilitation and/or construction purposes.
304.7 Extension of Temporary Parking Permit Period. Persons who have been issued a Temporary Parking Permit may have the time period for which parking is permitted extended by requesting an extension of the permit period in writing prior to the expiration of the issued Temporary Parking Permit. The extension of any Temporary Parking Permit period is within the sole discretion of Springfield Township.
304.8 Revocation of Temporary Parking Permit. Springfield Township reserves the right to revoke any Temporary Parking Permit issued if it determines, in its sole discretion, that the moving van, trailer, semi-trailer, dumpster, or portable storage unit (POD) creates a hazard or danger to the travelling public or pedestrians. If the Township determines the hazard or danger to be significant or if the moving van, trailer, semi-trailer, dumpster, or portable storage unit (POD) can be reasonably and quickly moved to another, safer location, the Township will require the immediate relocation of the moving van, trailer, semi-trailer, dumpster, or portable storage unit (POD). In all other cases, the Township will require that the moving van, trailer, semi-trailer, dumpster, or portable storage unit (POD) is moved within twenty-four (24) hours of the notification that it must be relocated.
CHAPTER 4
FIRE LANE PARKING PROHIBITIONS
SECTION 401
GENERAL PROHIBITIONS
401.1 Fire Lane Prohibitions. Parking is prohibited in any area designated as a fire lane.
SECTION 402
SPECIFIC SCHOOL PROPERTY DESIGNATED AS FIRE LANES
402.1 Brent Elementary School. The following portions of the Brent Elementary School property are designated as fire lanes in which parking is prohibited:
- Along the main entrance and exit to and from Brent Drive.
- Along the entrance and exit loop to and from Brent Drive.
- Along the service drive on the south side of the building.
- Along the entrance and exit driveways to and from additional parking area.
- Along the access in additional parking area to Northeast corner of building.
402.2 Finneytown High School. The following portions of the Finneytown High School property are designated as fire lanes in which parking is prohibited:
a) Along the curb on the right hand side of the driveway from the Fontainebleau Terrace entrance.
b) In front of Building 100, along the right hand side of the driveway and exit areas.
402.3 Hillcrest School. The following portions of the Hillcrest School property are designated as fire lanes in which parking is prohibited:
a) Both sides of the circle driveway.
402.4 North Junior High School. The following portions of the North Junior High School property are designated as fire lanes in which parking is prohibited:
a) All areas along the curbs.
402.5 St. Xavier High School. The following portions of the St. Xavier High School property are designated as fire lanes in which parking is prohibited:
- In all of the immediate areas adjacent to the school building, with the exception of a fifteen (15) foot approximate area located immediately to the right of the loading dock.
- All driveway areas.
- Beginning fifteen (15) feet to the left of the main entrance to the Keating Natatorium and extending to the right side of said building for the entire length of said facility, as designated by signs or markings on the property.
SECTION 403
SPECIFIC SHOPPING CENTER PROPERTY DESIGNATED AS FIRE LANES
403.1 Brentwood Plaza Shopping Center. The following portions of the Brentwood Plaza Shopping Center are designated as fire lanes in which parking is prohibited:
- At the loading dock at 8501 Winton in the area of the roll up dock doors only loading and unloading is permitted for a distance of approximately 18 feet from the existing wall (the pavement shall be striped with yellow paint and the area posted by the property owners at their expense).
403.2 Brentwood Shopping Center Stores. The following portions of the Brentwood Shopping Center Stores are designated as fire lanes in which parking is prohibited:
- Along the sidewalk in front of all Brentwood Shopping Center stores.
- Along the south side of building, with the exception that parking of a dumpster is permitted.
- Along the entire north side of the building parallel with Hempstead Drive.
- At the rear of the building the entire western fence line parallel with the closest to Cottonwood Drive, and the eastern rear building.
403.3 Sevenhills Shopping Center. The following portions of the Sevenhills Shopping Center are designated as fire lanes in which parking is prohibited:
- The traffic lane adjacent to the curb and sidewalk on Hamilton Avenue in front of said stores.
403.4 Wintondale Shopping Center. The following portions of the Wintondale Shopping Center are designated as fire lanes in which parking is prohibited:
a) In front of the stores along the curb.
SECTION 404
MISCELLANEOUS PRIVATE PROPERTY DESIGNATED AS FIRE LANES
- 6300 Daly Road. A fire lane has been established and parking is prohibited as designated by signs or markings on the property.
SECTION 405
PORTIONS OF STREETS DESIGNATED AS FIRE LANES
405.1 Abbie Place. A fire lane has been established and parking is prohibited for the entire length of this street on the fire hydrant side.
405.2 Banbury Street. A fire lane has been established and parking is prohibited for the entire length and on the east side of this street.
405.3 Caldwell Drive. A fire lane has been established and parking is prohibited as designated by signs or markings on the property.
405.4 Cottonwood Drive. A fire lane has been established and parking is prohibited on the fire hydrant side of this street from Hempstead Drive to Mockingbird Drive.
405.5 Deblin Drive. A fire lane has been established and parking is prohibited for the entire length of this street on the fire hydrant side.
405.6 Deerhorn Drive. A fire lane has been established and parking is prohibited for the entire length of this street on the east side.
405.7 Forester Drive. A fire lane has been established and parking is prohibited for the entire length of this street on the north side.
405.8 Fountainebleau Terrace. A fire lane has been established and parking is prohibited for the entire length on the north side of this street.
405.9 Garfield Street. A fire lane has been established and parking is prohibited on the west side of this street from 2135 Garfield Street, south to the end of the street, then north to 2150 Garfield Street.
405.10 Golfway Drive. A fire lane has been established and parking is prohibited for the entire length of this street on the fire hydrant side.
405.11 Jadwin Street. A fire lane has been established and parking is prohibited for the entire length and on the east side of this street.
405.12 Kenbyrne Court. A fire lane has been established and parking is prohibited for the entire length of this street on the fire hydrant side.
405.13 Marley Street. A fire lane has been established and parking is prohibited for the entire length and on the east side of this street.
405.14 Mayfair Street. A fire lane has been established and parking is prohibited for the entire length and on the east side of this street.
405.15 McClure Avenue. A fire lane has been established and parking is prohibited for the entire length of this street on the fire hydrant side.
405.16 Mockingbird Drive. A fire lane has been established and parking is prohibited on the fire hydrant side of this street from Hempstead Drive to Fontainebleau Terrace.
405.17 Monalisa Court. A fire lane has been established and parking is prohibited for the entire length of this street on the fire hydrant side.
405.18 Morning Glory Lane. A fire lane has been established and parking is prohibited for the entire length of the cul-de-sac.
405.19 Newberry Street. A fire lane has been established and parking is prohibited for the entire length and on the east side of this street.
405.20 Pinehollow Drive. A fire lane has been established and parking is prohibited on the north side of this street for the entire length of the street.
405.21 Reynard Drive. A fire lane has been established and parking is prohibited on both sides of this street from Brent Drive westwardly to Winton Road.
405.22 Roland Street. A fire lane has been established and parking is prohibited for the entire length and on the east side of this street.
405.23 Ross Avenue. A fire lane has been established and parking is prohibited for the entire length of this street on the fire hydrant side.
405.24 Sprucehill Drive. A fire lane has been established and parking is prohibited on the east side of this street, south of Roosevelt Avenue.
405.25 Terrylynn Lane. A fire lane has been established and parking is prohibited for the entire length of this street on the fire hydrant side.
405.26 Vacationland Drive. A fire lane has been established and parking is prohibited on the fire hydrant side of this street from Cottonwood Drive to Mockingbird Drive.
405.27 Woodland Avenue. A fire lane has been established and parking is prohibited for:
- The entire length of this street on the fire hydrant side.
- East of the driveway of 1302 Woodland eastward to a point west of the driveway at 1314 Woodland Avenue, a distance of approximately one hundred twenty-three (123) feet.
CHAPTER 5
SPECIAL EVENT/TEMPORARY PARKING PROHIBITIONS
SECTION 501
GENERAL PROHIBITIONS
501.1 General Statement. The parking prohibitions set forth in this section have been established due to specific traffic hazards and safety concerns associated with temporary events and conditions. The Township shall post temporary “No Parking” signs in the affected areas at least twenty-four (24) hours in advance of such temporary events unless such notice is not possible or practical given the nature or timing of the event.
501.2 Greek Festival. Parking is prohibited on the non-fire hydrant side of Greenfield Drive to Timber Trail, Greenfarms Drive and Timber Trail to the City line, Springbrook Drive, Greenfringe Lane, Winsray Court, Winsray Place, Greentree Drive, Thornfield Lane, Cloverfield Lane and Harbury Drive to Sandalwood Lane from twelve noon to twelve midnight each day of the Greek Festival.
501.3 Hummer Park Parking Lot. Parking is prohibited as follows:
a. At any time when the park is closed unless written permission has been granted for after hours parking by the Township.
b. During park hours by persons not utilizing the park facility or who are not otherwise authorized to park in the parking lot by the Township during park hours.
501.4 Road Construction/Maintenance. Parking is prohibited on both sides of any Township street when the same is undergoing construction, resurfacing, or being tarred and chipped.
501.5 Miscellaneous Temporary Parking Prohibitions. Parking is prohibited at any location and for any duration deemed necessary by the Township as a result of conditions, events, or activities which render parking hazardous or contrary to the public safety and welfare.
CHAPTER 6
SNOW EMERGENCY PARKING PROHIBITIONS
SECTION 601
PROHIBITIONS
601.1 Snow Emergency Parking Prohibition. Parking is prohibited upon any Township street on which signs are posted in accordance with this chapter.
601.2 Erection of Traffic Control Devices to Provide Notice of this Section. Signs conforming to R.C. 4511.09 and indicating the existence of these snow emergency regulations shall be erected at all entrances to Township subdivisions at locations to be determined by the Township.
601.3 Weather Conditions Upon Which a Snow Emergency May Be Declared. A snow emergency may be declared whenever snow/ice removal or treatment by Township trucks, plows, or other vehicles is necessary in all or parts of the Township due to:
a. Snow which has accumulated to a depth of three of more inches; and/or
b. The accumulation of ice in amounts deemed by the Township to create hazardous road conditions.
601.4 Declaration of Snow Emergency. The Township Road Superintendent, Township Administrator, or President of the Board of Township Trustees, may declare a snow emergency and make an announcement of such emergency to the local news media, requesting that the local news media announce that such an emergency has been declared, specifying the hour the declaration will go into effect, and indicating whether the snow emergency will remain in effect for a specified period of time or indefinitely until canceled by a subsequent announcement to the local news media by the Road Superintendent, the Township Administrator, or the President of the Board of Township Trustees.
601.5 Duration of Snow Emergency. The parking prohibitions set forth in this chapter shall be in effect two hours following the Township declaration of a snow emergency and announcement of such emergency to the local news media. The snow emergency will remain in effect for the specified period of time provided in the announcement or until canceled by a subsequent announcement to the local news media by the Township.
CHAPTER 7
ENFORCEMENT
SECTION 701
UNLAWFUL ACTS
701.1 Unlawful acts. It shall be unlawful for a person to be in conflict with or in violation of any of the provisions of these regulations.
SECTION 702
PENALTIES AND FINES
702.1 Violation Penalties. Any person who violates any of these regulations or any regulation or order adopted pursuant to these regulations is guilty of a minor misdemeanor.
SECTION 703
TOWING AND IMPOUNDMENT
703.1 Right to Tow/Impound Vehicles. The Township Road Superintendent, the Township Administrator, the Chief of Police, or any Township police officer may order into storage and tow, or have towed, any vehicle parked in violation of these regulations. The owner or any lien holder of a vehicle ordered into storage may claim the vehicle upon presentation of proof of ownership, which may be shown by a certificate of title to the vehicle, and payment of all expenses, charges, and fines incurred as a result of the parking violation and removal and storage of the vehicle.
703.2 Notice of Impoundment. In the event that a vehicle is towed and impounded pursuant to Section 703.1 of this Chapter, the Township shall immediately cause a search to be made of the records of the bureau of motor vehicles to ascertain the owner and any lienholder of the vehicle ordered into storage. If the owner and/or lienholder is found, the Township shall send or cause to be sent notice to the owner or lienholder that the vehicle will be declared a nuisance and disposed of if not claimed within twenty (20) days of the date of mailing of the notice. The notice shall be sent to THE owner’s or lienholder’s last known address by certified mail with return receipt requested. The owner or lienholder of the vehicle may reclaim it upon payment of any expenses or charges incurred in its removal and storage, and presentation of proof of ownership, which may be evidenced by a certificate of title or memorandum certificate of title to the vehicle. If the owner or lienholder of the vehicle reclaims it after a search of the records of the bureau has been conducted and after notice has been sent to the owner or lienholder as described in this section, and the search was conducted by the Township or the owner of the place of storage, and the notice was sent to the vehicle owner or lienholder, the owner or lienholder shall pay to the Township or other place of storage a processing fee of twenty-five dollars ($25.00) in addition to any expenses or charges incurred in the removal and storage of the vehicle.
703.3 Unclaimed Vehicles. If the owner or lienholder makes no claim to the vehicle within twenty (20) days of the date of mailing of the notice, and if the vehicle is to be disposed of at public auction as provided in section 4513.62 of the Revised Code, the chief of police shall file with the clerk of courts of the county in which the place of storage is located an affidavit showing compliance with the requirements of this section. Upon presentation of the affidavit, the clerk, without charge, shall issue a salvage certificate of title, free and clear of all liens and encumbrances, to the chief of police. If the vehicle is to be disposed of to a motor vehicle salvage dealer or other facility as provided in section 4513.62 of the Revised Code, the chief of police shall execute in triplicate an affidavit, as prescribed by the registrar of motor vehicles, describing the motor vehicle and the manner in which it was disposed of, and that all requirements of this section have been complied with. The chief of police shall retain the original of the affidavit for the chief’s records, and shall furnish two copies to the motor vehicle salvage dealer or other facility. Upon presentation of a copy of the affidavit by the motor vehicle salvage dealer, the clerk of courts, within thirty (30) days of the presentation, shall issue to such owner a salvage certificate of title, free and clear of all liens and encumbrances.
SECTION 704
ABATEMENT AND OTHER LAWFUL REMEDIES
704.1 Abatement of violation. The imposition of the fines and penalties herein prescribed shall not preclude Springfield Township from instituting, by and through its law director, appropriate action to enjoin, restrain, correct or abate a violation, or to stop an illegal act.
BE IT FURTHER RESOLVED that traffic control devices (signs) conforming to Section 4511.09 of the Ohio Revised Code shall be prominently displayed for purposes of enforcing provisions of this Resolution.
BE IT FURTHER RESOLVED that the Township Fiscal Officer shall cause a copy of this Resolution to be posted in five (5) conspicuous places in the Township for a period of thirty (30) days. Additionally, the entire Resolution shall be posted on the Township website and shall be available as a printed document at the Township Administrative Offices during normal business hours. The section headings, numbers, a brief summary, and the availability of “The Springfield Township Parking Regulations” shall be published in a newspaper of general circulation in the Township for two consecutive weeks.

Trustee Bryan moved for the adoption of the following Resolution:
WHEREAS, Section 302.2 of the Springfield Township Parking Regulations requires the adoption of a schedule which lists each street on which parking is prohibited or restricted in Springfield Township;
WHEREAS, the Board of Township Trustees originally enacted the required schedule on March 8, 2011 in Resolution Number 24-2011;
WHEREAS, since the enactment of the original schedule, it has become necessary to prohibit or restrict parking on additional streets within Springfield Township;
WHEREAS, Section 302.3 of the Springfield Township Parking Regulations permits the Township to modify the schedule of streets on which parking is prohibited or restricted from time to time by resolution to ensure that all streets on which parking is prohibited or restricted are included on the schedule;
WHEREAS, on July 25, 2012, the Board of Township Trustees enacted Resolution No. 75-2012 modifying the schedule of streets on which parking is prohibited or restricted;
WHEREAS, on August 14, 2012, the Board of Township Trustees enacted Resolution No. 79-2012 modifying the schedule of streets on which parking is prohibited or restricted; and
WHEREAS, since that time it has become necessary to further modify the schedule of streets on which parking is prohibited or restricted.
NOW THEREFORE BE IT RESOLVED BY THE SPRINGFIELD TOWNSHIP BOARD OF TRUSTEES that the Springfield Township Parking Prohibition/Restriction Schedule is hereby modified to read as follows:
Pursuant to Chapter 3, Sections 302.2 and 302.3 of the Springfield Township Parking Regulations, the following is a list of the particular streets on which parking is prohibited or restricted in Springfield Township. This list contains only those areas in which parking is prohibited or restricted solely on the basis of street identification and does not include those areas in which parking is prohibited or restricted for any other reason, including time-specific parking regulations and fire-lane designations. Those prohibitions and restrictions are contained in the body of the Parking Regulations.
- Adams Ridge Drive. Parking is prohibited on the east side of this street from the intersection of Adams Road and Adams Ridge Drive north to the beginning of the driveway at 2187 Adams Ridge Drive.
- Belgreen Lane. Parking is prohibited on both sides of this street from 11887 Belgreen to 11855 Belgreen Lane.
- Colette Lane. Parking is prohibited on the west side of this street from the posted sign to the corner of Colette Lane and Galbraith Road, a distance of fifty (50) feet.
- Deauville Road. Parking is prohibited on the west side of this street from Balleyclare Terrace to Morning Glory Lane.
- Deerhorn Drive. Parking is prohibited on the west side of Deerhorn Drive from 12099 Deerhorn Drive north to John Gray Road.
- Forester Drive. Parking is prohibited on this street as follows:
- On the east side of this street from a point fifty-seven (57) feet east of a driveway located at 1543 Forester Drive to a point approximately one hundred forty-five (145) feet eastwardly.
- At the Mill Road intersection on the east side of this street from the posted sign to the corner of Forester and Mill Road, a distance of thirty-nine (39) feet east from Mill Road.
- Fourth Avenue. Parking is prohibited at the Simpson Avenue intersection on both sides of this street from the posted sign to the corner of Fourth Avenue and Simpson Avenue, a distance of one hundred eight (108) feet east from Simpson Avenue.
- Fountainebleau Terrace. Parking is prohibited on this street as follows:
- Between 8929 to 8895 Fountainebleau Terrace on south side of the street as designated by signs.
- From the sign located at 8875 Fountainebleau Terrace east to Winton Road on the south side of the street.
- Hempstead Drive. Parking is prohibited on both sides of this street as follows:
- For a distance of ninety (90) feet east of Melody Lane on the North side of the street.
- On the west side of the street to appoint thirty (30) feet south of Hempstead Drive.
- Hudepohl Avenue. Parking is prohibited on both sides of this street from Hamilton Avenue to Overview Lane.
- Kenbyrne Court. Parking is prohibited on the west side of this street from the posted sign to the corner of Kenbyrne Court and Deblin Drive, a distance of forty (40) feet south of Deblin Drive.
- Laurel Avenue. Parking is prohibited on both sides of this street from Vine Street west to 10 Laurel Avenue.
- Locust Avenue. Parking is prohibited on the west side of this street from the Wyoming corporation line, southwardly to a point approximately two hundred twenty (220) feet north of Compton Road.
- Lux Avenue. Parking is prohibited on the non-fire hydrant side of this street from 271 Lux Avenue to 279 Lux Avenue.
- Madeline Circle. Parking is prohibited on the north side of this street from the corner of Dalbren Lane, east to 1156 Madeline Circle.
- Maria Avenue. Parking is prohibited on both sides of this street from the posted sign to the corner of Maria Avenue and Springdale Road, a distance of two hundred and sixty (260) feet.
- W. McKelvey Road. Parking is prohibited on the north and south sides of this street from the east property line of 879 W. McKelvey Road to the intersection of W. McKelvey Road and Wildbrook Lane.
- Monsanto Drive. Parking is prohibited on this street as follows:
- On the north side of this street from posted sign to the corner of Monsanto Drive and Murkett Court, a distance of thirty (30) feet south of Murkett Court on the east side of Monsanto.
- On the east side of this street from posted sign to fifty (50) feet north of Hempstead Drive.
- Murkett Court. Parking is prohibited on the north side of this street extending from the intersection of Monsanto Drive eastwardly thirty (30) feet.
- Northern Avenue. Parking is prohibited on both sides of this street from Simpson Avenue to Witherby Avenue.
- Pinemeadow Lane. Parking is prohibited on the north side of this street from the west end of the driveway located at 7989 Pinemeadow to the south end of the driveway located at 7956 Pinemeadow Lane.
- Roosevelt Drive. Parking is prohibited on the south side of this street from the Colerain Township line eastwardly to Hamilton Avenue.
- Shuman Lane. Parking is prohibited on both sides of this street as follows:
- For a distance of ninety (90) feet east of Melody Lane on the North side of the street.
- On the west side of the street to appoint thirty (30) feet south of Hempstead Drive.
- Sirius Lane. Parking is prohibited for the entire length of this street on both sides.
- Springbrook Drive. Parking is prohibited on the southeast side of this street, between 933 and 935 Springbrook Drive.
- Sprucehill Drive. Parking is prohibited on the east side of this street, south of Roosevelt Drive.
- Sunridge Drive. Parking is prohibited on the west side of this street from the intersection with North Bend Road for seventy-five (75) feet.
- Terway Lane. Parking is prohibited on the west side of this street from the driveway at 9791 Terway Lane to the corner of the intersection with W. McKelvey Road.
- Toulon Drive. Parking is prohibited on the west side of this street from the driveway located at 10591 Toulon Drive to a point approximately one hundred (100) feet northwardly.
- Twinridge Lane. Parking is prohibited on the west side of this street from the posted sign to the corner of Twinridge Lane and North Bend Road, a distance of approximately fifty-five (55) feet south from the North Bend Road intersection.
- Wellesley Drive. Parking is prohibited on the south side of this street, eastwardly seven hundred fifty (750) feet from View Place Drive.
- Windcrest Drive. Parking is prohibited on the fire hydrant side of the street for the entire length of the street.
BE IT FURTHER RESOLVED that the Springfield Township Parking Prohibitions/Restrictions Schedule may be modified from time to time by resolution to ensure that all streets on which parking is prohibited or restricted are included on the schedule.
BE IT FURTHER RESOLVED that the Springfield Township Parking Prohibitions/Restrictions Schedule may be modified by resolution at any time to allow parking on streets previously designated as no parking or restricted parking and to prohibit or restrict parking on streets on which parking was previously permitted.
BE IT FURTHER RESOLVED that the Township Fiscal Officer shall cause a copy of this Resolution to be posted in five (5) conspicuous places in the Township for a period of thirty (30) days. Additionally, the entire Resolution shall be posted on the Township website and shall be available as a printed document at the Township Administrative Offices during normal business hours.
